Counsel Fees
When a party hires an attorney, they assume responsibility of payment of the legal fees to that attorney. This is regardless of whether or not a party's spouse is required to make payments during the divorce or at the end of the divorce proceedings.
In New Jersey, attorney fees are allowable at all stages of the divorce. The statutes permit the court to order that a retainer fee be paid for services when the respective financial conditions of the party make it reasonable and just.
